Con el presente auto se resuelve la solicitud presentada por el Director Jurídico de la Fiscalía General de la Nación, en cuanto a decretar la nulidad de la totalidad del trámite del proceso correspondiente al expediente D-10339, por haberse presentado en él un desconocimiento al debido proceso.
La Sala Plena decide NEGAR la petición elevada por el ente investigador, en tanto considera que no se configura la violación alegada, por no existe realmente hasta el momento una decisión de fondo con efectos jurídicos sobre los ciudadanos y el funcionamiento de entidades estatales y, porque el Magistado Jorge Ignacio Pretelt Chaljub fue separado del conocimiento del asunto.
